The Company processes a series of personal data of Users (whether registered or not) when they use the Site and/or any Service offered by SC MANIL DISTRIBUTION SRL (for example when you participate in our contests and/or campaigns). 

This privacy policy (“ Policy ”) describes what types of personal data are processed, how they are used, what your options are in relation to these processings, and how We will respect your rights as a data subject under data protection legislation, including Regulation (EU) 2016/679 (“ GDPR ”).

2. WHAT DATA DO WE PROCESS?

The Company processes the personal data you provide to us when you use the Site (e.g. when you comment in the comments section), register on our page, contract a subscription, sign up for our campaigns (and/or campaigns organized together with our partners), wish to receive commercial communications or participate in our surveys and questionnaires, or contact us by any means of communication.

We also use cookies and similar technologies to recognize you and your devices. We also allow others to use cookies. How we use these technologies is described in our Cookie Policy.

Sending commercial communications, invitations to participate in contests, questionnaires or surveys

We wish to send you promotional materials, inform you about new products/services offered by the Company, invite you to participate in promotional lotteries, surveys or respond to questionnaires and to communicate other similar information that we consider may be of interest to you, including, if you agree, by sending you promotional materials/marketing communications regarding the products/services of the Company’s partners.

Organizing contests and promotions

If you agree, you can participate in contests and lotteries with prizes organized by us and/or our partners. Also, when we organize contests, we have a legitimate interest in processing data to carry out the related formalities for awarding the prizes claimed by the winners, resolving any complaints regarding the organization and conduct of the campaigns and the awarding of prizes; implementing the provisions of the regulation, investigating any violations, and making various reports.

Recording telephone conversations with winners of contests organized by us

We may record telephone conversations with persons declared winners in contests/lotteries organized by us. Recording conversations helps us manage our internal activity in the department dealing with promotions/marketing, but also to provide proof of the aspects agreed with the winners in case of potential disputes or litigation regarding the prizes awarded. Recording will only be done if we have the consent of the interlocutor.

Analyzing your interaction with the Company in order to provide personalized offers, [including based on advanced analytics]

In certain situations, we may use the information collected from you in combination with data we obtain from our sales and/or marketing teams regarding your interaction with the Company, to use in the context of our marketing communications. We want to streamline our marketing activity, offering our customers relevant and personalized products/services. Execution of the contract concluded with us

When you request the provision of subscriptions, we may process certain personal data necessary for these purposes (e.g. name and surname, delivery/supply address, transaction data, etc.)

We have the interest to provide adequate services through the Site to all persons who access it. Therefore, we process a series of personal data for the purpose of managing relations with the Site Users, for example when they contact us with various questions or requests regarding the Site functionalities, questions regarding the Company’s services offered through the Site, etc. Legal basis: art. 6(1)(f) GDPR – legitimate interest consisting in our interest to provide adequate services.

Analysis and statistics regarding the functioning of the site, cookies and similar technologies

We may use the personal data that Users provide or that we collect in the context of using the Services for the purpose of conducting analyses and statistics regarding our Services, including how the Site operates or the Services are offered. The analyses and statistics that we perform help us better understand how we could improve our Services or the functionalities of the Site. In conducting analyses and statistics, we also use cookies and other similar technologies in accordance with the Cookies Policy.

Cookies and similar technologies are also used to provide you with interest-based advertising.

Connecting through social networks

We have implemented various interconnection mechanisms with social media pages, such as Facebook, Twitter, Youtube and Instagram, so that you can access the content posted on our Site and or our associated accounts on those social networks more easily. If you access the content posted on those social networks or comment on those social networks, or access the Site through your Facebook account, a series of public data from your profile on those social networks will also be transmitted to us by the operators of those social networks.

Fulfillment of legal obligations

Sometimes data processing is necessary to fulfill our legal obligations, such as: · payment of relevant taxes and contributions (e.g. winners of competitions), reporting to relevant tax authorities and keeping accounting records; · archiving data in accordance with applicable legislation; · publishing the names of winners and prizes awarded in promotional lotteries organized

For the establishment, exercise or defense of a legal right in a court proceeding, an administrative proceeding or other official proceedings in which the Company is involved.

1. TO WHOM DO WE DISCLOSE DATA?

We may disclose your personal data to (i) entities and/or persons authorized by us (from the EEA or from third countries) involved in the provision of the Services, including in the provision of commercial communications (such as data center providers, payment service providers for various payment facilities, providers of e-mailing platforms such as Google Mail), the organization and conduct of our competitions / promotions (including when organized in partnership with other entities); (ii) if we are obliged to disclose personal data for the purpose of complying with any legal obligation or decision of a judicial authority, public authority or governmental body; or (iii) if we are otherwise required or permitted to do so under applicable law.

Also, your personal data may be disclosed to third-party providers of cookies and similar technologies as described in the Cookie Policy.

2. HOW LONG DO WE KEEP DATA?

We retain your personal data for as long as necessary to fulfill the purposes for which they were collected, in compliance with internal procedures regarding data retention, including applicable archiving rules. For example, if you are a subscriber of ours, your personal data will be retained for the entire duration of the contractual relationship, plus a minimum period of 3 years from termination (which is the limitation period for legal actions), also, if you are the winner of a competition organized by the Company, we may retain your personal data for a period of 3 years from the date on which the term in which the prize should have been claimed expired or from the date on which you claimed the prize. Subsequently, certain personal data may be retained for a longer period, for archiving purposes, in accordance with applicable archiving rules.

3. WHAT RIGHTS DO YOU HAVE AS A DATA SUBJECT?

According to the law, you are recognized as a data subject with the following rights:

a) Right of access

you can obtain from us confirmation that we are processing your personal data, as well as information regarding the specifics of the processing

b) The right to correct data

You can request that we modify your incorrect personal data or, as the case may be, complete data that is incomplete.

c) Right to erasure

You may request the deletion of personal data when: (i) they are no longer necessary for the purposes for which we collected and process them; (ii) you have withdrawn your consent to the processing of the data and we can no longer process them on other legal grounds; (iii) the data is processed unlawfully; or (iv) the data must be deleted in accordance with the relevant legislation.

d) Withdrawal of consent and right of opposition

You may withdraw your consent to the processing of your data based on consent at any time. You may also object at any time to the processing for marketing purposes, including profiling carried out for this purpose, as well as to the processing based on the legitimate interest of the Company, for reasons relating to your specific situation.
